USER AGREEMENT FOR CUSTOMERS

These terms and conditions constitute a legal “Agreement” concerning the provision of an online accommodation reservation service (“Service”) between You (“Customers”, “User”, “Your”) booking a reservation through our website or indirectly through any of our affiliates through whom we provide our services and Travel Masters (“The Company”, “TM”, "Travel Masters Limted", "Travel Elite Limited, "TEL",  “We”, “Us”, “Our”, “Ours”) a division of Texxon Group of Companies with registered offices at Suite A25, Ikota Complex, Victoria Garden City, Aja, Lagos Nigeria, its affiliates and/or distributors, suppliers and service providers. Your use of this web site is subject to your irrevocable acceptance without modification of the terms and conditions and notices contained herein and you agree to use this web site in accordance with and subject to these terms and conditions and notices. The terms and conditions set out hereunder constitute the entire agreement between you and Travel Masters. If You do not agree to these terms and conditions, do not use this Service. Travel Masters may extend the benefit of the arrangements in this agreement to its affiliates which offer an online travel and travel extras services under the Travel Masters brand.

PERSONAL AND NONCOMMERCIAL USE LIMITATION

This website is for your personal and noncommercial use only. The content and information found on this website (including, without limitation, price and availability of travel and travel extras services), as well as the infrastructure used to provide such content and information, is the property to Travel Masters or its suppliers and providers. As a condition of using this website, you agree not to use this website or its contents or information for any commercial or non-personal purpose. You are hereby granted a licence to make limited copies of your travel and travel extras itinerary (and related documents) for services purchased through this website, however you agree not to modify, copy, distribute, transmit, display, perform, reproduce, extract, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from this website. In addition, whether or not you have a commercial purpose, you agree not to:

(i) use this web site for any purpose that is unlawful or prohibited by these terms, conditions and notices.

(ii) access, monitor or copy any content or information of this website using any robot, spider, scraper or other automated means or any manual process for any purpose without express written permission of Travel Masters;

(iii) violate the restrictions in any robot exclusion headers on this website or bypass or circumvent other measures employed to prevent or limit access to this website;

(iv) take any action that imposes, or may impose, in the judgment of Travel Masters, an unreasonable or disproportionately large load on the Travel Masters infrastructure; or

(v) deep-link to any portion of this website (including, without limitation, the purchase path for any travel or travel extras services) for any purpose without express written permission of Travel Masters.

Travel Masters and its devices are registered trademarks of Texxon Group. You will ensure that You do not Use any of Travel Masters or its sisters companies trademark, including any copyrights, brands or logos without the express permission. This Site may contain third party trademarks from time to time. You do not have any right to use such third party trademarks without the express permission of that third party.

LIABILITY DISCLAIMER

In no event shall Travel Masters be liable to you for any services provided by accommodation owners whether or not such damages arose directly, indirectly, incidental or consequential as a result of a breach of contract and/or tortuous conduct or otherwise even if the other party has been advised of the possibility of such damages. All information on this website are provided by Travel Masters “AS IS” without any warranty and does not constitute the endorsement and/or recommendation of such products or/or services by TravelMasters,com or its affiliates.

Travel and Travel Extras suppliers, Accommodation Owners are all independent contractors and not agents or employees of Travel Masters and its affiliates. Travel Masters and its affiliates are therefore not liable for the acts, errors, omissions, representations, warranties, breach of contract and/negligence of any such service providers or for any personal injuries, death, property damage, other damages or expense resulting therefrom. Travel Masters and its affiliates exclude all liabilities and will make no refund in the event of delays, cancellations, over bookings, strikes, force majure or other causes beyond their direct control, and Travel Masters have no responsibility for any additional expenses, omissions, delays, re-routing or acts of any governmental authorities.

Travel Masters takes reasonable endeavour to ensure that the Service and Sites remain fully functioning and up to date. However it may, on occasions be necessary to close or suspend provision of any of the Services on the Sites for the purposes of repair, maintenance or development. In no event shall Travel Masters, its affiliates, and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way related to the use of this website, or information, software, products, and services obtained through the use of this website whether such damages are alleged as a result of a breach of contract, tortuous conduct/strict liability or otherwise even if Travel Masters and its affiliates has been advised of the possibility of such damages. For jurisdictional purposes, this limitation of liability may not apply to you. INDEMNIFICATIONYou agree to defend and indemnify Travel Masters, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by:

(i) you or on your behalf in excess of the liability described above; or

(ii) by third parties as a result of

(iii) your breach of this agreement or the documents mentioned herein;

(iv) your violation of any law or the rights of a third party; or

(v) your use of this website.-

Use of the Website

Your use of this web site is subject to your irrevocable acceptance without modification of the terms and conditions and notices contained herein and you agree to use this web site only for lawful purposes and in accordance with and subject to these terms and conditions and notices herein. The terms and conditions and notices set out hereunder constitute the entire agreement between you and Travel Masters.

This website may contain links to websites operated by parties other than the Travel Masters group. Such links are provided for your reference only. Travel Masters does not have control over such websites and is therefore not responsible for the contents of such sites or your use of them. The inclusion of links to such websites does not constitute any form of endorsement of the material on such sites or any association with their operators.

BOOKING CONDITIONS

The following conditions apply to accommodation bookings made by you through your usage of Travel Masters. These conditions may be altered at any time by Travel Masters.

MAKING A RESERVATION

Pre-paid Booking:- If the accommodation you have chosen to book is one that the accommodation provider has specified pre-payment then your credit/debit card would be charged the full amount before your arrival

10% Deposit Required:- Some accommodation providers require a 10% deposit when you book. If the accommodation you have chosen to book has such condition then only 10% of the total would be charged to your credit/debit card. You would be required to pay the balance to the accommodation provider on check out from the accommodation including any extras.

No Payment Required:- Some accommodation providers do not require you to pre-pay or pay any deposit at the point of booking the accommodation through us. If the accommodation you have chosen to book does not require any form of payment before arrival, we will still require your credit/debit card details to guarantee the accommodation but your card will not be charged. You will be responsible to the accommodation provider for full payment of the accommodation cost together with the payment of charges for any additional services you subsequently contracted for with the provider and, where applicable, payment of the provider's service charges and taxes pursuant to the terms and conditions of trade applied by the accommodation provider.

In all cases, it is a condition of using our service that you must use a credit card to guarantee a reservation. By making a reservation with your credit card you authorise the accommodation provider to charge one nights room charge to your credit card without further reference to you in the event that you cancel your reservation outside the "cut off" cancellation date as specified in the cancellation policy from your agreed check- in time or if you fail to arrive "No show". Your non-arrival will result in the cancellation of your entire reservation. Amendments to your reservation must be notified to and agreed with the Travel Masters in writing before they are effective.

When making a reservation, it shall be your responsibility to disclose to the accommodation provider any physical or mental condition to which you or a member of your party is subject to and of which the accommodation provider should be notified and which may require special facilities.

WHEN A RESERVATION IS CONFIRMED

Travel Masters will issue the booking voucher on behalf of the provider for each reservation, but does not undertake to include charges for additional services or details of the service charge or taxes of the accommodation provider. Travel Masters strongly recommends you check the cancellation policy upon which the accommodation provider makes the reserved service available on receipt of the booking confirmation voucher. You must take particular note of your Booking ID, your TM reservation reference number and check that your name and other details are correct. These details on the booking confirmation voucher should be quoted in all enquiries, cancellation or modification request of the reservation.

CANCELLATIONS

Hotels can be cancelled or modified in accordance with each property's cancellation policy. Some properties impose penalties such as one night's stay if cancelled within a certain number of days before your scheduled check-in date. Other discounted rate properties like "Travel Masters Special Rate" charge a small fee irrespective of when the modification is requested. In order to cancel or modify your booking please go to your Customer Login Area and click on the Cancellation/Modification link against the booking you want to cancel. Review the cancellation penalty and click on submit. Some accommodation do not allow a modification once booked. In such cases you would be able to cancel the original booking. Once you recieve confirmation of the cancellation in writing from Travel Masters you can then proceed to make a new booking of your choice. Please note that cancellation penalties may apply.

Please note that Travel Masters shall not accept any liability for losses, additional expenses or any claim whatsoever due to changes in accommodation, sickness, force majure, strikes or any other cause. All such losses, additional expenses or claims will be borne by the person who has booked the accommodation.

NO LIABILITY IN CREDIT CARD TRANSACTION

Travel Masters takes all reasonable efforts to ensure that all online credit card transactions are secure. Your credit card details can be provided to the accommodation providers if a request for such is made to Travelmastersng.com in order that the accommodation provider might effect the necessary charges in case of cancellation which does not comply with their cancellation policies. HOWEVER, if unauthorised charges appear on your credit card statement for that card used on Travel Masters at any time during or after you make your reservation, conduct your transaction or disclosed your credit card details on the Web site, Travel Masters shall not be liable or responsible in any way in respect of any damage or loss of whatsoever nature suffered by you arising from or in any way connected with the said use, transaction or disclosure.

WAIVER

Travel Masters failure to enforce at any time or for any period any one or more of the terms and conditions of this Agreement shall not be a waiver of them or the rights attaching to any of them.

HEADINGS

The headings used in this Agreement are for convenience only and shall not affect the meaning or scope of this Agreement or otherwise be given other legal effect.

MODIFICATION OF THESE TERMS AND CONDITIONS

Travel Masters reserves the right to change the terms, conditions and notices under which this web site is offered and you agree to accept and be bound by those terms, conditions, notices that are in effect at the time of your use of the website and its facilities.

GENERAL

This Agreement is governed and construed in accordance with the laws of The Federal Republic of Nigeria and all parties submit to the exclusive jurisdiction of the Nigerian Courts, in all disputes arising out of or relating to the use of this website. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Travel Masters as a result of this agreement or use of this website.

Travel Masters performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Travel Masters Nigeria Limited's right to comply with law enforcement requests or requirements relating to your use of this website or information provided to or gathered by Travel Masters with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

Travel Masters with respect to this website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and TravelMasters.com with respect to this website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Fictitious names of companies, products, people, characters, and/or data mentioned herein are not intended to represent any real individual, company, product, or event. Any rights not expressly granted herein are reserved.

USE OF TAVEL MASTERS NIGERIA'S WEBSITE

The Travel Masters website is provided solely to assist customers in determining the availability of travel and travel-related goods and services and to make legitimate reservations. You warrant that you are at least 18 years of age and possess the legal capacity to enter into this agreement and to use this website in accordance with all terms and conditions contained herein.

You agree to be financially responsible for all of your use of this website (as well as for use of your account by others, including, without limitation, minors living with you). You agree to supervise all usage of this website by minors under your name or account. You also warrant that all information supplied by you or members of your household in using this website is true and accurate. Without limitation, any speculative, false, or fraudulent reservation or any reservation in anticipation of demand is prohibited. You agree that the travel and travel extras services reservations facilities of this website shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. You understand that overuse or abuse of the travel services reservation facilities of this website may result in you being denied access to such facilities permanently.

Separate terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. You agree to abide by the terms or conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of accommodations, fares, products, or services. You understand that any violation of any such supplier’s conditions of purchase may result in cancellation of your reservation(s) or purchase and in your being denied access to any flights, accommodation, or automobiles, in your forfeiting any monies paid for such reservation(s) or purchase, and in Travel Masters debiting your account for any costs Travel Masters or Our suppliers incurs as a result of such violation. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this website.

USER ID AND PASSWORD

You agree that Your User ID and password are kept confidential and ONLY used to access Your reservation information on the Website and in order to view/print/cancel your booking only.

CURRENCY CONVERTER

The Currency Converter we provide on our search result page are for guidance only. Currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Currency quotes are not updated every day. Check the date on the Currency Converter for the day that currency was last updated. The information supplied by this application is believed to be accurate, but Travel Masters, its partners/affiliates and/or their suppliers do not warrant or guarantee such accuracy. When using this information for any financial purpose, Travel Masters advises the customer to consult a qualified professional to verify the accuracy of the currency rates. Travel Masters, its partners/affiliates and/or their suppliers do not authorize the use of this information for any purpose other than personal use and prohibit to the maximum extent allowable the resale, redistribution, and use of this information for commercial purposes.
